THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");

NOTING the Trial Chamber Order for Return to United Nationals Detention Unit of 24th September in which the Trial Chamber ordered the suspension of the provisional release of the Accused, Pavle Strugar ("Order");

NOTING that the Co-Accused, Vladimir Kovacevic, was arrested on 25th September 2003;

CONSIDERING that, Kovacevic has not been transferred to The Hague yet and that it may be appropriate to try the accused together;

NOTING that the Trial Chamber has today adjourned the commencement of the Trial to a date to be fixed;

PURSUANT TO Rules 54 and 65 of the Rules of Procedure and Evidence;

HEREBY ORDERS that

  1. the Order of 24th September 2003 be vacated;
  2. the Accused Pavle Strugar shall remain on provisional release under the terms of the Trial Chamber’s Decision on Request for the Pre-Trial Provisional Release of 18th November 2001;

DIRECTS the Registrar to take all necessary steps for the continuance of the provisional release of the Accused;

REQUESTS the Government of Serbia and Montenegro to take notice that the Accused’s transfer to the Kingdom of the Netherlands Hague on 6th October 2003 is not required.
