I, Judge David Hunt, Pre-Appeal Judge in this appeal,
NOTING the "Defence Appeal Brief Concerning Rule 68 Violations", filed confidentially on 10 April 2003 ("Defence Motion");
NOTING the Scheduling Order of 22 April 2003 in which the Prosecution was ordered to file its Response to the Defence Motion no later than 1 May;
NOTING the "Order on Extension of Time" of 1 May 2003 in which the Prosecution was granted leave to file its Response no later than 8 May;
BEING SEISED OF a "Defence Motion for Extension of Time to File its Reply Brief", dated 7 May 2003, in which the Defence seeks a two-week extension of time in which to file its Reply to the Prosecution’s Response;
NOTING that the Defence says that other professional commitments would make it impossible to comply with the 4-day time frame in which to reply;
NOTING that the Prosecution itself was granted an extension of time in which to file its Response to the Defence Motion; 1
NOTING that the Prosecution informed the Appeals Chamber orally that it does not object to the extension of time being granted;
NOTING that the Prosecution also informed the Appeals Chamber that its Response will be in the range of 40 pages;
CONSIDERING that good cause has been shown;
HEREBY GRANT the Defence the 14-day extension of time sought in which to reply to the Prosecution’s Response.
