THE APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of a Motion filed by the Appellant on 7 December 1998 entitled "Motion to Vary Scheduling Order of 25th November 1998 and to Adjourn Status Conference of 9th December 1998" seeking a postponement of the status conference scheduled for 9 December 1998 until 25 January 1999, and referring, inter alia, to the possibility of a future application for leave to amend the Notice of Appeal and the Appellant’s Brief,

NOTING THAT the Office of the Prosecutor ("Prosecution") has orally advised the Legal Officer to the Appeals Chamber that it has no objection to the proposed rescheduling but that it would object strongly to any further delay in the presentation of the Appeal and Cross-Appeal,

HEREBY ORDERS as follows:

  1. the closed session status conference to be held on Wednesday 9 December 1998 is hereby cancelled;
  2. the Appellant shall file any application for leave to amend the Notice of Appeal and the Appellant’s Brief by Friday 8 January 1999;
  3. the Prosecution shall file its response thereto by Monday 18 January 1999;
  4. oral argument on such application for leave to amend shall, if needed, be heard on Monday 25 January 1999 commencing at 10 a.m., to be followed by a closed session status conference;
  5. dates for hearing oral argument on the appeal, cross-appeal and appeal on sentencing shall be set by the Appeals Chamber as soon as practicable thereafter.
