THE APPEALS CHAMBER

NOTING that at the hearing on 22 January 1998 the Appeals Chamber ordered the Appellant to file by 5 February 1998 a legal memorandum and additional statements in support of its Motion for leave to admit additional evidence, such additional statements to be in one of the working languages of the International Tribunal,

NOTING that on 5 February 1998 the Appellant filed its Brief In Relation To Admission Of Additional Evidence On Appeal Under Rule 115 together with supporting material,

NOTING that the supporting material included 18 video-tapes, some of which are recorded in a language other than one of the working languages of the International Tribunal,

NOTING that transcripts of the video-tapes in one of the working languages were submitted by the Appellant to the Registry of the International Tribunal on 23 February 1998,

NOTING that on 23 February 1998 the Appellant also submitted one additional video-tape with transcript and that no reason was given for the late submission of this item,

CONSIDERING that, with one exception, the substantive items, namely the 18 video-tapes, were submitted in time,

PURSUANT to Rule 127 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY ORDERS AS FOLLOWS:

the late filing of the transcripts is accepted; and

the late filing of the additional video-tape and transcript submitted on 23 February 1998 is accepted.
