THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("Tribunal"), is seised of a "Partly Confidential Prosecution Motion for Testimony to be Heard via Video-Link Conference with Confidential Annex A", filed on 20 October 2006 ("Motion"), in which the Prosecution requests, pursuant to Rules 71 bis and 73 of the Rules of Evidence and Procedure ("Rules"), that the evidence of witness K58, scheduled for the week of 6 November 2006, be received via a video-conference link.

  1. As of today, the Defence has not responded to the Motion. Pursuant to Rule 126 bis, the Defence response, if any, has to be filed within fourteen days of the filing of the Motion, namely on Friday, 3 November 2006. The Trial Chamber notes, however, that witness K58 is scheduled to give evidence in the week of 6 November 2006, that is, one working day after the Defence response is due.
  2. The Trial Chamber considers that Rules 54 and 127 of the Rules allow the Trial Chamber to vary, proprio motu, the time limits prescribed by the Rules. Accordingly, pursuant to Rules 54 and 127, the Trial Chamber hereby ORDERS that the Defence shall file a response, if any, by Monday, 30 October 2006.
