I , THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991,

NOTING the "Joint Defence Interlocutory Appeal of Trial Chamber Decision on Enver Hadzihasanovic and Amir Kubura’s Rule 98 bis Motions for Acquittal" filed on 2 November 2004;

NOTING the "Décision Relative à la Demande de Certification de l’Appel de la Décision Rendue en Vertu de l’Article 98 bis du Règlement" rendered by Trial Chamber II on 26 October 2004;

CONSIDERING the composition of the Appeals Chamber of the Tribunal as set out in Document IT/222, dated 17 November 2003;

CONSIDERING Articles 12(3) and 14(3) of the Statute of the Tribunal, and Rule 73 of the Rules of Procedure and Evidence of the International Tribunal;

NOTING Article 14(2) of the Statute of the Tribunal, which provides that the President of the Tribunal is ex officio the Presiding Judge of the Appeals Chamber;

HEREBY ORDER that the five-judge bench of the Appeals Chamber in Case No. IT-01-47-AR73.3, The Prosecutor v. Enver Hadzihasanovic and Amir Kubura, shall be composed, with immediate effect, as follows:
