TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"):

BEING SEISED OF the Prosecution’s Motion for Leave to Amend the Amended Indictment against Naser Oric (“Accused”) filed on 23 September 2004 ("Motion")

NOTING that the Defence does not object to the Motion, as stated during the Pre-Trial Conference on 28 September 2004,1

CONSIDERING that the Trial Chamber made an oral ruling granting the Motion at the Pre-Trial Conference, but invited the Prosecution to clarify one minor matter in the submitted Amended Indictment,2

NOTING that pursuant to this invitation, the Prosecution filed the Prosecution’s Addendum for Further Leave to Amend the Second Amended Indictment on 1 October 2004 ("Second Motion"),

CONSIDERING that the Second Amended Indictment contains the said clarification and no other amendments,

PURSUANT TO Rule 50(A) of the Rules of Procedure and Evidence of the Tribunal,

HEREBY GRANTS the Second Motion and ORDERS that the Second Amended Indictment filed by the Prosecution on 1 October 2004 is the operative indictment against the Accused.
