TRIAL CHAMBER II ("Trial Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal"):

NOTING the Decision on Form of Consolidated Amended Indictment and on Prosecution Application to Amend, issued by the Trial Chamber on 23 January 2004 ("Decision");

CONSIDERING that the text of the Decision’s disposition reads in part:

    1. DECIDES that a further appearance of Radic and Sljivancanin will be scheduled by the Trial Chamber to be held as soon as practicable thereafter to allow them to enter a plea on the new charges contained in the Consolidated Amended Indictment;
    2. DECIDES that Mrksic, Radic and Sljivancanin shall have a further period of 30 days, i.e. until no later than 8 March 2004, in which to file preliminary motions pursuant to Rule 72 in respect of the new aspects of the Consolidated Amended Indictment.

CONSIDERING that, to be consistent with the rest of the disposition and to dispel any ambiguity, the word "modified" should be inserted so that the relevant part would instead read:

    1. DECIDES that a further appearance of Radic and Sljivancanin will be scheduled by the Trial Chamber to be held as soon as practicable thereafter to allow them to enter a plea on the new charges contained in the modified Consolidated Amended Indictment;
    2. DECIDES that Mrksic, Radic and Sljivancanin shall have a further period of 30 days, i.e. until no later than 8 March 2004, in which to file preliminary motions pursuant to Rule 72 in respect of the new aspects of the modified Consolidated Amended Indictment.

MINDFUL of the difficulties caused by the inconsistent use of terms to refer to the various subsequently amended indictments, and out of an abundance of caution,

FOR THE FOREGOING REASONS

HEREBY ORDERS that the disposition of the Decision be altered to read as set out above.
