Prosecutor v. Mitar Vasiljevic

DECISION

THE REGISTRAR,

CONSIDERING the Statute of the Tribunal as adopted by the Security Council under Resolution 827 (1993), and in particular Article 21 thereof;

CONSIDERING the Rules of Procedure and Evidence as adopted by the Tribunal on 11 February 1994, as subsequently amended, and in particular Rules 44 and 45 thereof;

CONSIDERING the Directive on Assignment of Defence Counsel (hereinafter "the Directive") as adopted by the Tribunal on 28 July 1994, as subsequently amended, and in particular, Articles 6, 8, 10, and 16 thereof;

CONSIDERING that on 17 September 2003, Mr. Vladimir Domazet, assigned counsel to Mr. Mitar Vasiljevic (hereinafter "the accused") by a decision of the Registrar dated 17 March 2000, requested the assignment of Mr. Gerardus Godefridus Johannes Knoops, attorney at law from Amsterdam as co-counsel to the accused and the withdrawal of Radomir Tanaskovic, assigned co-counsel to the accused by a decision of the Registrar dated 3 September 2001;

CONSIDERING that on 17 September 2003, Mr. Knoops was assigned co-counsel for a temporary period of 30 days in The Prosecutor v. Stanisic pending before the Tribunal;

CONSIDERING that under Article 16 (G) of the Directive, other than in exceptional circumstances, no counsel shall be assigned to more than one accused at a time;

CONSIDERING however that the Registrar has determined that there is no conflict between the former and present assignment, particularly since the appellate proceedings in the present case will conclude in the coming months;

CONSIDERING that Mr. Stanisic does not object to Mr. Knoops’ assignment to the present case given his written waiver filed with the Registry on 29 September 2003;

CONSIDERING that on the basis of Article 16 (C) of the Directive, the Registrar may assign a second counsel to assist the lead counsel in the interests of justice;

CONSIDERING that Mr. Knoops meets the requirements for assignment as set forth in Article 14 of the Directive;

DECIDES to withdraw Mr. Tanaskovic and assign Mr. Knoops as co-counsel for the accused, effective as of 13 October 2003;
