THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),
BEING SEISED of a confidential "Prosecution’s Motion for Leave to Amend the Witness List to call Lord David Owen" filed by the Office of the Prosecutor ("Prosecution") on 21 August 2003 ("the Motion"), in which the Prosecution seeks leave to modify the Prosecution Witness List to include Lord David Owen or, alternatively, for Lord Owen to be called as a witness by the Trial Chamber pursuant to Rules 89 and 98 of the Rules of Procedure and Evidence of the International Tribunal ("Rules"),
CONSIDERING that the Trial Chamber is of the view that Lord Owen ("the Witness") may be able to provide significant relevant evidence in connection with these proceedings and that it would be in the interests of justice to summon the Witness,
CONSIDERING that it would be of assistance to have the benefit of a written statement of the testimony of the Witness in advance of his oral testimony,
PURSUANT TO Rules 54, 89 and 98 of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY ORDERS as follows:
