I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

NOTING the composition of the Appeals Chamber in this case set out in my order of 17 June 2003;

NOTING that under Article 14(2) of the Statute of the International Tribunal I am ex officio Presiding Judge over this case;

NOTING that the Appeals Chamber is seised of an interlocutory appeal filed by counsel for Mile Mrskic ("Defence") on 4 June 2003, to which the Office of the Prosecutor ("Prosecution") has responded on 16 June 2003;

NOTING that the Appeals Chamber is also seised of the "Defence Request for Leave to Reply to the ‘Prosecution’s Response to the ‘Defence Brief on an Interlocutory Appeal on the Trial Chamber’s Decision on Defence Motion Requesting the Determination of Rules for Communicating with Potential Witnesses of the Opposite Party’" filed by the Defence on 19 June 2003;

NOTING that Rule 65ter of the Rules, read together with Rule 107 of the Rules, authorizes the Presiding Judge of the Appeals Chamber to designate a member of the Appeals Chamber to be responsible for pre-appeal proceedings ("Pre-Appeal Judge");

CONSIDERING the need to ensure an efficient and expeditious handling of the appeal proceedings;

HEREBY DESIGNATE, with immediate effect, Judge Inés Mónica Weinberg de Roca as Pre-Appeal Judge in this case.
