DECISION ON ZORAN ZIGIC’S MOTION FOR TRANSLATION OF DOCUMENTS PERTAINING TO HIS APPEAL

I, Judge David Hunt, Pre-Appeal Judge,

NOTING that, on 8 July 2002, the Registry withdrew the assignment of Mr Slobodan Stojanovic ("Stojanovic"), lead counsel for Zoran Zigic ("Zigic") upon evidence that he had split his fees with his client;

NOTING that, in his letter filed on 15 August 2002, Zigic requested the Registry to allow Stojanovic to continue to represent him in relation to these proceedings;

NOTING that, in his "Statement of Zoran Zigic’s Defense [sic] Counsel" filed on 25 September 2002, Stojanovic undertook "as a temporary solution" to represent Zigic on a "non-assigned basis";

BEING SEISED OF Zigic’s "Request for Providing All Material Translated in BCS", dated 25 September 2002 but filed on 1 October 2002 ("Request"), whereby Zigic requests that he receive "all material translated in BCS, submitted to the ICTY and all decisions rendered by ICTY since 08.07.2002 until now";

NOTING that the prosecution informed the court that it did not have any objection to Zigic’s Request;

NOTING that, in his Request, Zigic states that he does not accept the representation of Mr Stojanovic on a pro bono basis;

CONSIDERING that Zigic is now without legal representation and that he must therefore prepare his appeal by himself;

CONSIDERING that it is essential for an appellant who is not represented, as in the present case, to receive in a language which he understands, all the documents directly relating to his appeal;

HEREBY GRANT the Request and ORDER that the following documents be translated into BCS, if that is not already the case, and DIRECT the Registry to provide these documents in BCS to the appellant as soon as they have been translated or immediately if they have already been translated in that language:

  1. Decision of the Registrar concerning withdrawal of his counsel, 8 July 2002.
  2. Consolidated Prosecution Respondent’s Brief, 15 July 2002.
  3. Motion for Separation of Appellant Zigic’s Appeal Procedure, 23 July 2002.
  4. Prosecution’s Response to the Motions of the Appellant Kvocka for Extension of Time and for Separation of the Appeal of Zigic, 26 July 2002.
  5. Motion to Freeze Proceeding Against Accused Zoran Zigic Until Clarification of His Defense [sic] Status, 29 July 2002.
  6. Motion to Present Additional Evidence, 23 August 2002.
  7. Modification of Motion to Freeze Proceeding Against Accused Zoran Zigic Until Clarification of His Defense [sic] Status, 23 August 2002.
