THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),
BEING SEISED of a "Prosecution’s Motion for Leave to Call Kevin Curtis" filed by the Office of the Prosecutor ("Prosecution") on 7 August 2002 ("the Motion"),
NOTING the prior oral Decision of the Trial Chamber of 20 February 2002 denying leave to the Prosecution to call this witness,
NOTING that the evidence to be presented by this proposed witness relates to three issues: the history of the Kosovo investigation conducted by the Prosecutor of the International Tribunal; the exhumation of bodies in Serbia; and the arrest of the accused,
CONSIDERING that the Motion reveals no new relevant evidence for consideration by the Trial Chamber,
PURSUANT TO Rule 73 bis of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY DENIES the Motion.
