I, RICHARD MAY, Judge of Trial Chamber III of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of Orders of the Trial Chamber dated 13 April 2000 and 24 January 2001,

BEING SEISED of a joint application entitled "Joint Request for Meeting with Pre-trial Judge Pursuant to Rule 65 ter (I) and Request to Defer Filing of Prosecutor’s Final Pre-trial Brief" filed on behalf of all parties on 30 October 2001 ("the Joint Request"), in which the parties seek: (a) the opportunity to be heard without the presence of the accused, pursuant to Rule 65 ter of the Rules of Procedure and Evidence of the International Tribunal ("Rules") to discuss the preparation of the case; and (b) deferral of the date for filing of the Prosecution pre-trial brief pending such meeting,

NOTING that the date set by me for filing of the final pre-trial brief by the Office of the Prosecutor ("Prosecution") was 31 October 2001,

NOTING also that a status conference in the presence of the accused has been scheduled for Wednesday 7 November 2001,

CONSIDERING that, due to the urgency of the Joint Request, I instructed the Senior Legal Officer of the Trial Chamber to inform the parties orally that the date for filing of the Prosecution pre-trial brief would be vacated until further order,

HEREBY ORDER as follows:

the oral instruction vacating the date for filing of the Prosecution pre-trial brief is confirmed;

the status conference scheduled for Wednesday 7 November 2001 is cancelled; and

a meeting with counsel pursuant to Rule 65 ter of the Rules will take place in the absence of the accused on Wednesday 7 November 2001, commencing at 2.30 p.m.
