I, FAUSTO POCAR, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

NOTING the "Prosecution Response to Appellant’s Motion to Admit Additional Evidence on Appeal Pursuant to Rule 115" ("the Prosecution’s Response to the Appellant’s Brief in Support of Rule 115 Motion") filed confidentially on 19 April 2001; the "Appellant’s Reply Memorandum in Support of Appellant’s Motion to Admit Additional Evidence on Appeal Pursuant to Rule 115, in Accordance with the Appeals Chamber Decision of 26 September 2000" ("the Appellant’s Reply"), and the "Declarations and Exhibits in Support of Appellant’s Reply Memorandum in Support of Appellant’s Motion to Admit Additional Evidence on Appeal Pursuant to Rule 115, in Accordance with the Appeals Chamber’s Decision of 26 September" ("the Declarations and Exhibits in Support of the Appellant’s Reply") both filed under seal on 18 June 2001;

CONSIDERING that submissions may be filed confidentially (or under seal) only when there are real security concerns;

NOTING that no specific grounds have been addressed by the parties to justify the confidentiality of their submissions;

HEREBY ORDERS the parties to file a public version of each of the following documents within seven days of the filing of this order:

    1. the Prosecution’s Response to the Appellant’s Brief in Support of Rule 115 Motion,
    2. the Appellant’s Reply, and
    3. the Declarations and Exhibits in Support of the Appellant’s Reply.
