ORDER TO VACATE IN PART THE ORDERS FOR NON-DISCLOSURE OF 17 DECEMBER 1999 AND FOR TRANSMISSION OF WARRANT OF ARREST

I, Almiro Rodrigues, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

NOTING the amended indictment, IT-99-36-I, which I confirmed on 17 December 1999 pursuant to Articles 18 and 19 of the Statute, and Rules 28 and 47 of the Rules of Procedure and Evidence,

CONSIDERING my orders on 17 December 1999, which ordered the non-disclosure of the amended indictment, supporting materials and warrants of arrest in respect of Stojan ZUPLJANIN, the accused still at large.

CONSIDERING the Warrant Of Arrest Ordering Transfer Addressed To The Authorities Of Bosnia and Herzegovina for the Accused Stojan ZUPLJANIN, which I issued on 17 December 1999,

BEING SEISED of a Motion to Vacate In Part The Orders For Non-Disclosure Of 17 December 1999, filed on 13 July 2001,

CONSIDERING that this application would require that the orders of 17 December 1999 be vacated in part in order to make the indictment public and in order that the amended indictment and warrant of arrest in respect of Stojan ZUPLJANIN may be served by the Registrar on the authorities of Bosnia and Herzegovina,

PURSUANT TO Rules 53, 53 bis, 54, 55 of the Rules of Procedure and Evidence of the Tribunal;

ORDER that:

1. The orders of non-disclosure of 17 December 1999 be vacated in part insofar as there shall be public disclosure of the amended indictment IT-99-36-I and warrant of arrest;

2. The amended indictment, warrant of arrest and accompanying documents issued to the authorities of Bosnia and Herzegovina in respect of the accused Stojan ZUPLJANIN be transmitted by the Registrar to the authorities of Bosnia and Herzegovina forthwith; and

3. The supporting materials not be disclosed to the public until further order from the confirming Judge or Trial Chamber II.
