THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of a confidential "Application for Provisional Release by the Accused (Rule 65 (A) & (B))" filed on behalf of the accused, Biljana Plavsic on 19 February 2001 ("the Motion"),

NOTING the "Prosecutions Motion for Extension of Limit upon Length of Motion and Abridgement of Time Period for Application" and the "Prosecution’s Response to Defence’s Application for Provisional Release filed on 19 February 2001" ("Response") both filed by the Office of the Prosecutor ("Prosecution") on 2 March 2001, requesting the Trial Chamber to accept an oversized filing and objecting to the relief sought in the Motion,

NOTING that the Motion and Response do not relate to, and have not been served on, the co-accused, Momcilo Krajisnik,

NOTING that the Response still exceeds the limit on such responses set down in Practice Direction (IT/184) of 19 January 2001,

CONSIDERING, however, that it is in the interests of justice to accept the filing of the Response so as to be able to determine the Motion as promptly as possible,

HEREBY ORDERS as follows:

  1. the Response is accepted as properly and timely filed in these proceedings;
  2. oral argument on the Motion shall be heard on Friday 16 March 2001, commencing at 9.30 a.m.; and
  3. it is not necessary for the co-accused, Momcilo Krajisnik, to attend the hearing.
