THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal");

NOTING the Decision on Motion by Prosecution for Protective Measures issued by the Trial Chamber on 8 September 2000 ("Decision on Protective Measures") in which the Trial Chamber ordered, in paragraph 2 of the orders, that the Prosecutor supply to the accused Mitar Vasiljevic (“Vasiljevic”) copies in unredacted form of the supporting material which accompanied the indictment when confirmation was sought (“Order 2”);

NOTING the status conference held on 22 September 2000 at which counsel for Vasiljevic advised the Trial Chamber that he did not require at this time the identity of witnesses who made statements which accompanied the indictment when confirmation was sought and therefore did not require at this time copies of those statements without the identifying material redacted;

NOTING the indication made by the Office of the Prosecutor ("prosecution") in the Status Conference that it would be in a position to file a pre-trial brief after an interview was held with Vasiljevic and that such interview was likely to take place in mid-November;

HEREBY ORDERS THAT

1. The Decision on Protective Measures is varied so that the requirement to disclose the documents referred to in Order 2 is stayed until further notice.

2. The prosecution shall file a pre-trial brief which satisfies the requirements of Rule 65ter (E)(i) before 4 p.m. on Monday, 11 December 2000.
