THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEIZED of a motion filed on behalf of Momcilo Krajisnik ("the accused") challenging the jurisdiction of the International Tribunal ("the Motion"),

NOTING the response to the Motion filed by the Office of the Prosecutor and the accused’s reply,

NOTING that, while Judge Bennouna was unable to attend the hearing on 19 July 2000 at which both parties presented oral arguments, he has had an opportunity to review the transcripts, and has participated fully in the deliberations,

HAVING CONSIDERED the oral and written submissions of the parties,

PURSUANT TO Rule 72 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY DIMISSES the Motion.
