ORDER REGARDING PUBLIC BROADCAST OF COURT PROCEEDINGS
The Office of the Prosecutor:
Mr. Mark Harmon
Mr. Tomislav Vijnic
Defence Counsel:
Mr. Nenad Petrusic
TRIAL CHAMBER I of the International Tribunal for the Prosecution of
Persons Responsible for Serious Violations of International Humanitarian Law Committed in
the Territory of the Former Yugoslavia since 1991 (hereinafter "the Trial
Chamber");
CONSIDERING
that the Prosecution and Defence have asked the Trial
Chamber to delay public release of the evidence that will be tendered by the Prosecution
on 28 July 2000 for one week, until 4 August 2000;
CONSIDERING
that Rules 75 and 79 of the Rules of Procedure
(hereinafter "the Rules"), allow the Trial Chamber to conduct a closed session
for reasons of the safety and security of victims or witnesses or the interests of
justice;
CONSIDERING
that the "Guidelines for Audio-Visual Director to
Follow When Recording Tribunal Proceedings" normally provide for video transmission
of open session court proceedings to the media with a 30-minute delay, but, for obvious
reasons, do not provide for transmission of closed session testimony;
CONSIDERING
that Rule 81(b) allows the Trial Chamber to order the
disclosure of all or part of the record of closed proceedings when the reasons for
ordering its non-disclosure no longer exist;
PURSUANT TO
Rules 75, 79, and 81 and the "Guidelines for
Audio-Visual Director to Follow When Recording Tribunal Proceedings";
HEREBY ORDERS
that a portion of the hearing on 28 August 2000 will
be held in closed session and shall not be transmitted to the media; and that the exhibits
received during this portion of the hearing and the transcript shall be under seal;
FURTHER ORDERS
that the audio-visual recording of this session shall
be unsealed and transmitted to the media one week later, at 9:30 a.m. on 4 August 2000, at
which time it shall be shown in the public gallery of courtroom III; and that the exhibits
tendered during this session and the transcript of the session shall also be unsealed at
that time.
