THE APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),
NOTING the "Defendants Notice of Appeal Pursuant to Rule 108", filed on 17 May 1999, and the "Prosecutions Notice of Appeal", filed on 19 May 1999;
NOTING the "Motion to Determine Time-Period for Filing Appellants Brief" ("Motion to Determine Time-Period"), and the "Joint Motion by the Prosecution and the Appellant Zlatko Aleksovski Seeking a Variation of the Time Limit for Filing of Appellants Briefs" ("Joint Motion"), both filed on 22 July 1999;
NOTING that the written Judgement in the case of Prosecutor v. Zlatko Aleksovski (IT-95-14/1-T) was filed on 25 June 1999;
NOTING that the Parties state that they have not been able to prepare their respective briefs prior to receiving the written Judgement;
CONSIDERING that this constitutes "good cause" for the variation of time limits pursuant to Rule 127 of the Rules of Procedure and Evidence ("Rules");
CONSIDERING THEREFORE that the date of filing of the Appelants briefs pursuant to Rule 111 should be determined not from the date of the notice of appeal, as provided by the Rule, but from the date of the filing of the written Judgement;
PURSUANT TO Rules 111, 112, 113 and 127 of the Rules of the International Tribunal,
HEREBY GRANTS the Joint Motion, and ORDERS as follows:
1. The Appellants briefs and authorities shall be filed by 24 September 1999;
2. The Respondents briefs and authorities shall be filed within thirty days of the filing of the Appellants briefs, at the latest by 25 October 1999;
3. The Appellants may file briefs in reply within fifteen days after the filing of the Respondents briefs, at the latest by 10 November 1999.
As the Motion to Determine Time-Period is worded in the alternative to the Joint Motion and since the latter is granted it is not necessary to decide on the former.
