THE APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),
NOTING the amended "Respondents Brief of Argument on the Brief of Argument of the Prosecution (Cross-Appellant)" submitted by the Appellant on 19 January 1999 ("the Substitute Brief") which the Appellant seeks to substitute for the version filed with the Appeals Chamber by the previous lead counsel on 24 July 1998,
NOTING the "Submission in relation to Appellants "Substitute Brief" filed on 19 January 1999" filed by the Office of the Prosecutor ("Prosecution") on 24 February 1999, in which the Prosecution confirms that the Substitute Brief "appears to the Prosecution to raise no new grounds of appeal" and that the Prosecution "does not object to the Substitute Brief supplanting the prior submission, it being understood that any substantial points raised in the prior submission that are not raised in the Substitute Brief, are to be regarded as abandoned",
NOTING also the provisions of its Scheduling Order of 17 February 1999 regulating the further conduct of proceedings this matter,
CONSIDERING that, in the absence of any objection from the Prosecution, acceptance of the Substitute Brief would assist the Appeals Chamber in its understanding and resolution of the matters before it,
FOR THESE REASONS,
PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal
HEREBY ACCEPTS the filing of the Substitute Brief.
