I, MOHAMED BENNOUNA, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia ("International Tribunal"),

HAVING BEEN APPOINTED as pre-trial Judge in this matter by virtue of an Order of the Trial Chamber dated 12 January 1999,

BEING SEISED of a "Prosecutor’s Request for Order pursuant to Rule 90 (E)" filed by the Office of the Prosecutor ("Prosecution") on 11 January 1999 ("the Request"),

NOTING that no objection to the Request has been raised by any of the Defence and that the time for so doing has now expired,

PURSUANT TO Rule 90 (E) of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY GRANTS THE REQUEST and ORDERS that the Prosecution lead investigator, Mr. Mazhar Inayat, shall not be precluded from being called as a witness on the ground that he has been present in the courtroom during the proceedings.

The Defence are at liberty to apply for a similar order in respect of their lead investigators at any stage of the proceedings.
