THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

NOTING that the time-period for filing of preliminary motions pursuant to Rule 72 of the Rules of Procedure and Evidence of the International Tribunal ("Rules") has now elapsed,

PURSUANT TO Rules 54 and 73 bis of the Rules,

HEREBY ORDERS as follows:

  1. the Office of the Prosecutor ("Prosecution") shall complete disclosure of all material pursuant to Rule 66 of the Rules no later than Monday 7 December 1998 and shall confirm this to the Trial Chamber in writing;
  2. the Prosecution shall file its pre-trial brief setting out the details of the case and addressing the factual and legal issues pursuant to Rule 73 bis (B)(i) by Monday 11 January 1999;
  3. the Prosecution shall file the information specified in Rule 73 bis (B)(ii), (iii), (iv) and (v) by Monday 25 January 1999;
  4. the Defence shall file its response to the Prosecutor’s materials filed pursuant to Rule 73 bis (B)(v) by Monday 8 February 1999, confirming whether or not it has any objection as to authenticity;
  5. the Defence shall file its pre-trial brief and statement of admitted facts pursuant to Rule 73 bis (F) by Monday 8 February 1999; and
  6. the full statement of any expert witness to be called by the Prosecution shall be filed with the Trial Chamber pursuant to Rule 94 bis (A) as early as possible and the time for filing the Defence response pursuant to Rule 94 bis (B) shall run from the date of such filing.
