DECISION ON THE APPLICATION OF THE ACCUSED MR. MILAN SIMIC TO LEAVE HIS RESIDENCE FOR MEDICAL REASONS (2)

I, Claude Jorda, Presiding Judge of Trial Chamber I (hereinafter the "Trial Chamber"),

NOTING the new application for authorisation to leave the municipality of Bosanski Samac for medical reasons filed by the accused Milan Simic on 7 May 1998 (hereinafter the "application"),

NOTING the Decision for provisional release of the accused rendered by the Trial Chamber on 26 March 1998, a decision also ordering court supervision,

NOTING the Decision of 17 April 1998 authorising the accused to leave provisionally his residence for medical treatment,

PURSUANT to Rule 54 of the Rules of Procedure and Evidence,

CONSIDERING that, in support of its application, the Defence states that the accused finds it impossible to be treated on the dates initially envisaged,

CONSIDERING that the strict court supervision to which the accused is subject may not deprive him of obtaining treatment indispensable for his health; that the application covers only the period 12 to 19 May 1998; that this period should be extended to permit the accused to travel to the location where he can be treated and, then, to return under proper conditions,

FOR THE FOREGOING REASONS,

AUTHORISE exceptionally the accused to leave the municipality of Bosanski Samac to receive medical treatment in Belgrade for the period 11 to 20 May 1998,

ORDER the Defence to produce a detailed medical certificate at the end of that period which will permit the Trial Chamber to evaluate the medical condition of the accused.
