THE TRIAL CHAMBER,

CONSIDERING that Dragan Opacic, a witness called by the Prosecution in this case, is still subject to recall by this Trial Chamber,

CONSIDERING that Dragan Opacic was surrendered to the jurisdiction and custody of the International Tribunal by the relevant authorities of the Government of Bosnia and Herzegovina to give evidence before the International Tribunal after which he was to be returned, in custody, to such authorities,

NOTING that Dragan Opacic is currently detained pursuant to an Order for Detention dated 2 June 1995,

NOTING that the Prosecutor has indicated that steps should now be taken to return Dragan Opacic to the custody of the Republic of Bosnia and Herzegovina,

NOTING the Request of Counsel for Dragan Opacic filed on 16 May 1997 that the Prosecutor’s request for return be denied for the reasons set out therein,

HEREBY ORDERS the Prosecution to file its response to the Request of Counsel for Dragan Opacic by Monday, 26 May 1997.

Any further proceedings in this matter shall be the subject of further order.
