Article 5 of the Agreement provides: "Commercial Court
of the Commonwealth shall be created for the purpose of the
settlement of interstate economic disputes, which are not
justiciable by the highest domestics courts of arbitration and
commercial courts. Highest commercial courts and courts of
arbitration of the member-states of the Commonwealth of Independent
States shall file their propositions regarding members of the court
and a draft of the Regulation of the court at the next (or ordinary)
meeting of the Council of the Heads of States of the CIS."

of the Commonwealth of Independent States adopted by the Meeting
of the Council of the Heads of States in Minsk (Belarus).
Declaration of the Council of the Heads of States signed by
representatives of Armenia, Belarus, Kazakhstan, Kirghizstan,
Moldova, Russian Federation, Tadjikistan, Turkmenistan, Uzbekistan,
Ukraine.
Article 32 of the Charter provides: "The Economic Court
shall funtion with the aim to ensure the observation of economic
obligations within the framework of the Commonwealth. Under the
jurisdiction of the Economic Court there shall be settlement of
disputes, arising while the economic obligations are being executed.
The Court may also settle other disputes, referred to its
jurisdiction by the agreements of the member states. The Economic
Court shall also have the right to interpret the provisions of
agreements and of other acts of the Commonwealth on economic issues.
The Economic Court shall exercise its activities in complience with
the Agreement on the Status of the Economic Court and with the
Regulations on it, adopted by the Council of Heads of States. The
seat of the Economic Court shall be the city of Minsk." (see 34

Treaty
on Creation of an Economic Union was signed by Armenia, Azerbaijan,
Belarus, Kazakhstan, Kyrgystan, Moldova, Russian Federation,
Tajikistan, Uzbekistan signed signed in Moscow. Tukrmenistan and
Ukraine did not sign the treaty, but became associate members, with
Turkmenistan becoming a full member on December 24, 1993. Georgia
became a full member in October 1993.
Article 31 of the Treaty provides: "The Contracting
Parties pledge to resolve their disputes in respect to
interpretation and implementation of the present Treaty by means of
negotiations or through the Economic Court of the Commonwealth of
Independent States. If the Economic Court finds that a State Member
of the Economic Union has failed to fulfill an obligation under the
present Treaty, the State shall be required to take necessary
measures to comply with the judgment of the Economic Court. The
Contracting Parties shall work out and conclude a special agreement
on the procedures for deliberation of disputed issues in respect to
economic relations of the entities of the Member States of the
Economic Union, as well as on a system of sanctions for
non-fulfillment of the assumed obligations. If the Contracting
Parties fail to resolve their disputes by means of negotiations or
through the Economic Court of the Commonwealth of Independent
States, they have agreed to resolve them in other international
judicial bodies in accordance with their respective rules of

CIS shall produce a study, with the assistance of experts, of the
effectiveness of the Economic Court of the CIS, taking into account
the transition of this organ to the session basis as well as for the
purpose of making propositions in respect of its further
